4Th Martial Laws in Pakistan

5. Notwithstanding the repeal of the provisions of the Constitution, but subject to the orders of the Chief Executive, all laws other than the Constitution shall remain in force until amended, supplemented or repealed by the Chief Executive or any authority designated by him. In 2001, Musharraf issued the executive decree and eventually forced President Rafiq Tarar to resign so that Musharraf could take over the presidency. [13] In light of the Supreme Court`s decision, the national referendum took place on April 30, 2002, allowing him to continue his rule,[14][15] but was accused by many (including the Pakistan Human Rights Commission) of being fraudulent. [14] [15] In 2002, parliamentary elections restored democracy when the Musharraf-backed PML(Q), the libertarians, was able to form a minority government that Musharraf would later nominate for the 2004 presidential election. In 2007, President Musharraf finally imposed another martial law by suspending populist Chief Justice IM Chaudhry and bringing charges of corruption and misconduct. Unlike previous martial law, Musharraf was widely disapproved and invited mass protests led by Nawaz Sharif, Musharraf eventually resigned to avoid impeachment proceedings in parliament. [16] On October 1, the elections were postponed indefinitely. On November 10, 1977, the Supreme Court unanimously upheld the imposition of martial law under the doctrine of necessity. General Musharraf, however, firmly rejected the use of the words “martial law” or “coup” and instead insisted: “This is not martial law, just another path to democracy.” [52] The ISPR also confirmed that “there is no martial law in the country.” [3] The 3rd martial law was imposed on July 5, 1977, not on July 25 by G. Zia ul haq.

During Mirza`s reign, it passed some laws in the Assembly on the basis of the resolution and was already adopted on March 12, 1949. In October 1958, Pakistani President Mirza formed a 12-member cabinet, including many well-known personalities such as General Azam Khan, Manzoor Qadir and Zulfiqar Ali Bhutto. On October 1, 1971, the court rejected the elections and discussed martial law. After their discussion, General Zia Ul Haq had to abolish martial law and hand over the government to the appropriate personalities. In this way, martial law ended definitively. Zia`s martial law ended on December 30, 1985. On 15 July 1977, Justice Mushtaq Hussein was appointed by the Lahore Supreme Court to chair a committee to formulate electoral procedures and laws. Two days later, Judge Mushtaq Hussein also took office as Supreme Electoral Commissioner and announced that the elections would be held in the first half of October 1977 under the supervision of the armed forces and the judiciary. 18 October was set for the parliamentary elections and candidacy documents were invited between 7 and 18 August 1977. Martial law enforced by General President Zia introduced the strict but modern form of conservatism that promoted nationalist and religious programs.

[6] Under Zia`s dictatorship, a strong Islamization of the country took place (whose emblem was the so-called Hudood decrees), which distracted the country from the non-sectarian vision of Muhammad Ali Jinnah. Martial law has been declared 4 times in the history of Pakistan. Pakistan returned to military rule on October 12, 1999, when General Pervez Musharraf took power in a bloodless coup and dissolved the elected government of Nawaz Sharif. However, no martial law was imposed. As announced on 11 July 2002, parliamentary elections were held on 10 October 2002. But before the elections, a referendum was held on April 30, 2002 to elect him president for another five years. On 3 November 2007, he declared a state of emergency in the country, which would correspond to martial law, as the constitution was suspended. On November 12, 2007, Musharraf promulgated amendments to the military law that gave the armed forces additional powers. Ayub Khan was sworn in as President-elect on February 17, 1960. The 8.

In June 1962, he announced that martial law would be abolished after nearly four years, and also took the oath of office as president under the new constitution, which he issued on March 1, 1962, and provided for the presidential form of government.
